As user of this website (referred to as "you/your") you acknowledge that any use of this website including any transactions you make ("use/using") is subject to our terms and conditions below. 2.1 These Terms & Conditions govern the supply of goods sold by Cherished of 11 Market Street, Otley, LS21 3AF, to the customer named on the PayPal payment confirmation provided to the Cherished website. Together with the PayPal payment confirmation, these Terms & Conditions constitute the entire and only agreement between us in relation thereto. Our acceptance of your order by delivery of goods constitutes a legally binding contract between us on these terms and conditions. These Terms and Conditions do not affect your statutory rights.
2.2 We will confirm acceptance of your order. This will occur either by message on the website immediately after you have confirmed your order, or by PayPal payment confirmation for your order. We may do both, in which case the acceptance will occur on whichever arrives sooner of the web message and the e-mail. At this point the purchase contract will be made and we will supply the goods to you in accordance with your order and these Terms and Conditions.
2.3 All products are subject to availability, if your order cannot be fulfilled you will be contacted.
3.1 All orders must be paid for via PayPal.
3.2 The price payable for the goods you order is as set out on our web site at the time you place your order. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it . If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund.
3.3 We must receive payment for the whole of the price of the goods you order and any applicable charges for carriage before your order can be despatched.
3.4 Prices and delivery charges are subject to change without notice.
3.5 All prices are shown in pounds sterling inclusive of VAT, at the current rate of 20%.
4.1 There is no minimum order value.
4.2 There is a flat rate delivery charge of £3.95 per order for deliveries throughout the United Kingdom. We do not accept or deliver orders outside the UK.
4.3 Wherever possible your goods will be dispatched within 2 working days from receipt of your order, via Royal Mail. All items are sent 1st Class recorded delivery. This is subject to the items being in stock and Royal Mail services. This is postal service requires a signature upon receipt to ensure safe delivery at your address as specified on your PayPal order.
4.4 As soon as the goods are delivered to you, they become your responsibility. We will only deliver to the delivery address specified on the PayPal order.
4.5 We operate a recycling policy. Wherever possible all our packaging will be recycled.
4.6 Damaged, or faulty goods, must be reported within 48 hours of delivery date. In cases of goods received damaged or faulty please retain the product (together with any packaging) and contact us within 48 hours of receipt (commencing the day after delivery), whereupon we will arrange for the item to be exchanged or offer a full refund. This does not affect your statutory rights as a consumer.
We try to make sure we only show items on the site if we currently have them in stock or are expecting fresh stocks shortly. If you place an order for something, which isn't available, we will contact you by phone or email as soon as possible after you place your order. All orders are subject to availability.
Goods may be returned within seven days of receipt. These goods must be in perfect resalable condition and unopened in their original packaging Customers must ensure the goods are securely packed and are responsible for paying the relevant return carriage costs. This does not affect your statutory rights.
Shopping on our site is safe. We use Secure Servers to host our website. We have no access to your personal card details. All transactions are carried out via PayPal for security and for your protection as a buyer. More details can be found at www.paypal.co.uk
All information collected via the PayPal e-mail confirming payment is for internal use only, including customer and recipient personal details. This information is necessary to ensure the smooth processing of your order and allows us to contact you if any problems occur. We will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and We accept no liability of any kind for any loss or damage from action taken or taken in reliance on material or information contained on the site.
9.2 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
10.1 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion you use this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
10.2 If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
10.3 All copyright, trademarks and all other intellectual property rights in all material or content supplied as part of this website shall remain at all times vested in us or our licensors. You are permitted to use this material only for your personal use in placing orders through cherishedofotley.co.uk and you may not copy, reproduce, transmit, publish, display, distribute, commercially exploit or create derivative works of such material and content.
10.4 These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
